When we think about a car accident, we do not often think about how a pedestrian can be involved or injured in a crash.  In most cases the accident victims are inside the vehicles, but there are instances where a bystander or pedestrian can suffer devastating injuries. Victimized pedestrians hurt by a negligent driver are entitled to recover financially in much the same way a victim inside a car is allowed to make a claim against a negligent driver. It is important to note the injuries to a pedestrian may be more severe than injuries sustained by those riding in a car at the time of impact. This is because a pedestrian is not protected by a seatbelt or airbag and is unable to brace for impact. A pedestrian is unable to make an evasive driving maneuver and is therefore unable to avoid an accident, leaving the fault with the driver. Most pedestrian accidents are the result of reckless driving, speeding, distracted driving, or a driver who is under the influence of drugs or alcohol.
